According to Law.com, Biometric privacy is a hot topic. Biometrics are biological measurements or physical attributes that identify individuals. The technology can provide security, aid in payments, track wages, help with marketing, and more.
Law.com authors Lauren Caisman and Christian Auty write that much litigation, class action settlements, and legislative activity related to the use of facial recognition occurred in 2021. Fifteen states (Colorado, Kentucky, Maryland, Massachusetts, New York, South Carolina, Vermont, Washington, and West Virginia, to name a few) introduced biometric privacy-specific statutes.
Caisman and Auty report courts and legislatures may clarify and refine existing biometric statutes this year.
The authors believe that as the legal biometric privacy landscape changes, companies should ensure they have biometric-compliant policies in place.
